Abstract

The survival of a society depends on its social Governance. The law and order situation plays a central role in the establishment of social Governance. During the Makki era, law and order and the protection of human rights were influenced by tribal prejudices. Tribal affiliation was usually seen before helping the oppressed. After the fourth Harb ul Fijaar, the law and order situation in makki’s society had deteriorated. Under these circumstances, a man from the Zubayd tribe came to Makkah. A tribal leader of Makah, Aas bin Wa'i l Alsahmi, usurped his  financial  right. The oppressed called the tribal chiefs of Makkah for help. Zubair bin Abdul Muttalib Al Hashimi called the Makki chiefs to protect the oppressed.  Banu Taim, Banu Zahra and Banu Asad also supported him. They formed a joint platform known in history as the “Hilf Ul Fudhul”

It was a social contract to protect the society. The distinction of this agreement was to help the oppressed on the basis of humanity instead of tribal prejudices. At that time, the Holy Prophet (PBUH)was twenty years old. He was very satisfied to be a part of this agreement, which he later expressed on one occasion.

The agreement played a central role in improving social governance by improving the peace and order of the Makki community. This article examines in detail how the agreement improved the governance of the Makki Society. It also explains how it can be used in modern times.
