Islamic Insurance Laws: A Critical Jurisprudential Analysis of Contemporary Waqaf Model

Abstract

At this time the world has become a global village and human life has developed a lot and man has invented various types of machines to make life easier and to get the necessities of life and is moving forward in further industrial development. But along with this development, the dangers to human life are also increasing day by day, for example, a worker may lose a limb during work, die in an accident or become disabled in any way etc.

It is also human nature that he wants protection from all kinds of risks and wants to compensate the loss as much as possible. On this basis, the insurance system came into existence, which is basically a form of mutual cooperation, but with the increase in its practice, it took the form of business, when the scholars began to examine it carefully, many types of defects were revealed in it, such as usury, gambling and gharar. On the basis of these errors, Allama Ibn Abidin Shami first issued a fatwa on the prohibition of insurance, but insurance has now become a necessity, so the scholars became concerned that an alternative system of insurance should be brought which would be similar to it. The above should be free of all defects, so scholars in Malaysia and the Middle East have suggested an alternative based on donation, while scholars in Pakistan have suggested an alternative Islamic insurance (Takaful) based on Waqf In this article, Islamic insurance based on Waqf and its subjective study and critical analysis will be presented.
